Important Disclaimer: Pippachat is a lifestyle, personal growth, and wellbeing coaching application. It is not a medical device, therapist, diagnostic service, or crisis intervention service. If you are in crisis or experiencing an emergency, stop using the Service immediately and contact the appropriate emergency or crisis support services.

1. Introduction and Binding Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between the user ("the User") and Pippachat Ltd, a company registered in England and Wales ("the Company," "Pippachat").

By accessing, downloading, or utilizing the Pippachat website, application, or associated artificial intelligence voice services (collectively, "the Service"), the User acknowledges that they have read, understood, and agreed to be bound by these Terms. If the User does not agree to these Terms in their entirety, they must immediately cease use of the Service.

The Service is intended exclusively for Users residing within the United Kingdom. These Terms, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any such dispute.

2. Age Restriction and Legal Capacity

Access to the Service is strictly restricted to individuals who are eighteen (18) years of age or older.

By accessing the Service, the User warrants and represents that they are at least 18 years of age and possess the full legal capacity and authority to enter into a binding contract under English law. Pippachat Ltd expressly disclaims any liability arising from the unauthorized use of the Service by minors.

Age Restriction: By using the Service, the User confirms they are 18 years of age or older and legally capable of entering into a binding agreement.

3. Explicit Disclaimer of Medical and Therapeutic Services

The User explicitly acknowledges and agrees that Pippachat is exclusively a lifestyle, personal growth, and wellbeing coaching application.

The Service is not a medical device, diagnostic tool, or medical treatment. The Service has not been evaluated, cleared, or approved by the Medicines and Healthcare products Regulatory Agency (MHRA) or any other regulatory authority as a Software as a Medical Device (SaMD).

Pippachat Ltd does not provide clinical therapy, psychiatric evaluation, psychological counselling, or medical diagnosis. The Service acts solely as an artificial intelligence-driven wellbeing coach. The term "therapist" is not applicable to, nor representative of, the Service provided.

Information, insights, or conversational outputs generated by the Service must not be relied upon as a substitute for professional medical advice, diagnosis, or treatment. The User is solely responsible for their physical and mental health. The User agrees that they will not disregard professional medical advice or delay in seeking it because of information provided by the Service.

4. Crisis Management and Emergency Protocols

The User acknowledges that the Service is powered by generative Artificial Intelligence and is entirely unequipped and unintended to manage medical emergencies, severe psychological distress, or psychiatric crises.

The Service is not designed to assist Users experiencing active suicidal ideation, desires to self-harm, or intentions to harm others.

Mandatory Redirection: If the User is experiencing a medical or mental health emergency, feels unable to keep themselves safe, or is in crisis, they must immediately terminate their use of the Service and contact appropriate emergency services. In the UK, the User must dial 999, visit the nearest Accident and Emergency (A&E) department, or contact crisis support services such as the Samaritans (call 116 123) or the Shout crisis text line (text SHOUT to 85258).

5. Artificial Intelligence Interaction and Acceptable Use

The User acknowledges that they are conversing with an Artificial Intelligence system and not a human professional. AI systems are subject to limitations, including "hallucinations," wherein the system may generate factually incorrect, illogical, or inappropriate responses.

The User agrees to interact with the Service reasonably and lawfully. The User shall not:

Pippachat Ltd reserves the absolute right to immediately suspend or terminate the User's access to the Service, without notice or refund, if the User engages in prohibited conduct.

6. Limitation of Liability

The Service is provided on an "as is" and "as available" basis. Pippachat Ltd makes no representations or warranties of any kind, express or implied, regarding the operation of the Service, its fitness for a particular purpose, or the accuracy, reliability, or safety of the AI's conversational outputs.

Nothing in these Terms shall limit or exclude Pippachat Ltd's liability for:

Under no circumstances shall Pippachat Ltd be liable to the User for any indirect, consequential, special, or punitive damages, or for any loss of profit, loss of business, or depletion of goodwill arising from the use of, or inability to use, the Service.

7. User Indemnification

To the fullest extent permitted by law, the User agrees to fully indemnify, defend, and hold harmless Pippachat Ltd, its directors, officers, employees, agents, and third-party licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) that such parties may incur as a result of or arising from:

8. Data Privacy, Biometrics, and Voice Consent

The User acknowledges that utilizing the voice interaction features of Pippachat requires the collection and processing of audio recordings.

The User recognizes that voice recordings constitute biometric data, and any health-related discussions constitute health data, both of which are classified as Special Category Data under Article 9 of the UK General Data Protection Regulation (UK GDPR).

By activating the microphone and utilizing the voice features of the Service, the User provides their explicit, informed consent for Pippachat Ltd (and its authorized third-party data processors) to collect, store, and process their biometric and health data solely for the purpose of operating the generative AI wellbeing coach.

The User retains the absolute right to withdraw this explicit consent at any time by ceasing use of the voice features and requesting account deletion, at which point Pippachat Ltd shall execute the erasure of the User's personal and biometric data in accordance with its Privacy Policy and statutory obligations.

Voice Consent Notice: Using the voice features constitutes explicit consent to process biometric and health-related data for operation of the Service, subject to the User's right to withdraw consent and request deletion.

9. Modification of Terms

Pippachat Ltd reserves the right to amend, modify, or update these Terms at any time to reflect changes in regulatory frameworks, technological advancements, or business operations. Continued use of the Service following any such modifications constitutes the User's binding acceptance of the revised Terms.

By using Pippachat, the User acknowledges that they have read, understood, and agreed to be bound by these Terms of Service.

These Terms apply exclusively to Users residing within the United Kingdom and are governed by the laws of England and Wales.
